On March 5th, Governor Pritzker signed executive order 2021-05 to extend Illinois eviction moratorium to April 3, 2021. The order includes both an extension and also a change to the procedures for evictions.
What’s New:
Imminent threat / Dangerous Tenants Case- Once a landlord receives an Illinois Tenant Declaration from a tenant, the landlord may only proceed with the eviction if the tenant:

Pose a direct threat to the health and safety of other tenants
- Are an immediate and severe risk to the property

This means that emergency evictions can move forward even if a tenant is a “covered person” under the executive order. The clarification will help protect tenants from being evicted due to nonpayment, rather than other lease violations. Click here to read the full executive order.
